In 1975 the U.S. Supreme Court ruled, in the Weingarten decision, that an employee is entitled to have an association representative present during any interview which may result in his or her discipline. It is up to you to insist on representation. If you fail to do so you may waive your rights.
Know Your Rights to Representation If you are ever called into a meeting with your supervisor or manager so they can investigate a situation which might result in discipline, you have specific representational rights.

These rights are called “Weingarten Rights” based on a 1975 Supreme Court decision (NLRB vs. J. Weingarten). As with all rights, if we do not use them, we eventually could lose them.
What to Say If Management Asks Questions that Could Lead to Discipline?
“If this discussion could in any way lead to my being disciplined or terminated, or affect my personal working condition, I respectfully request that my Association Representative be present at this meeting. Without representation present, I choose not to answer any questions.”

- Do not resign or abandon your location.
- Document in writing the incident.
- Keep any records that relate to the incident.
- Representation is strongly advised.
- Timeliness is important, don't delay
- Use your contract as a guide.
- Follow orders unless there is a potential for personal injury. You can grieve the order later.
- Contact your UniServ Director for help.
- All communication with your UniServ Director is strictly confidential.
